Who we are and how to contact us

MaiWai App and www.maiwai.app are operated by Arland Property (App) Limited (“We”). We are registered in England and Wales under company number 11788746 and have our registered office at 58 Grosvenor Street, London, England, W1K 3JB.

Our service

We provide our services through a mobile App and website (“site”). MaiWai is about communication and community. It helps to create a good working environment by seeking to adapt some of the attractions of co-working space and bring them into a multi-let office environment.

The terms that may apply to you

These terms of use refer to the following additional terms, which also apply to your use of our App and site:

We may make changes to these terms

We amend these terms from time to time. Every time you wish to use our App or site, please check these terms to ensure you understand the terms that apply at that time.

We may make changes to our App and site

We may update and change our App and site from time to time to reflect changes to our services, our users’ needs and our business priorities. We will try to give you reasonable notice of any major changes.

Your MaiWai account

Our App is made available to a limited number of users who must register by creating a MaiWai account. You may need your own MaiWai account to use certain services, and you may be required to be logged into the account. You must ensure that the information you provide to create your account is accurate.

In order to register to use the App:

  • Your employer will provide MaiWai with your work email address;
  • MaiWai will send you an email with a single use password which will allow you to log into the App; and
  • You will be required to replace the single use password with a password of your own choosing.

You must keep your MaiWai account details safe

If you use any MaiWai service you are responsible for maintaining the confidentiality of your account and password and for restricting access to your device or computer, and to the extent permitted by applicable law you agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorised manner. You are responsible for ensuring that the details you provide us with are correct and complete, and for informing us of any changes to the information you have provided.

You can access and update your information in the “Settings” section of the App.

We have the right to disable any user account, identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at info@maiwai.app.

We may suspend or withdraw our App or site

We do not guarantee that our App or site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our App or site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

We may transfer this agreement to someone else

We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens.

Our App and site is only for users in the UK

Our App and site is directed to people residing in the United Kingdom. We do not represent that content available on or through our App or site is appropriate for use or available in other locations.

How you may use material or post content on our App or site

We are the owner or the licensee of all intellectual property rights in our App and site, and in certain material published on it (except in relation to user generated content). Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our App or site for your personal use and you may draw the attention of others within your organisation to content posted on our App or site. You may not frame or use framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout, or form) of MaiWai without our express written consent.

Our status (and that of any identified contributors) as the authors of content on our App and site must always be acknowledged. You must not use any part of the content on our App or site for commercial purposes without obtaining a licence to do so from us or our licensors.

User generated content

If you post comments, questions or answers, or other content generated by you for display on the App or site (including any images, video or audio, all together “content”, you grant MaiWai (a) a non-exclusive, royalty-free licence to use, reproduce, publish, make available, translate and modify such content throughout the world (including the right to sublicense these rights to third parties) and (b) the right to use the name that you submit in connection with such content. No moral rights are transferred by this provision.

You may delete content that you have posted in the App from public view or, where such functionality is offered. For example, you will be able to delete notice board items, room bookings, ride share or shop listings. Users cannot delete conversations with receptionists or maintenance tickets once they have been created.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is posted: (i) the content and material is accurate; and (ii) use of the content and material you supply does not breach any applicable policies or guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify MaiWai for all claims brought by a third party against MaiWai arising out of or in connection with the content and material you supply except to the extent that any liability arises from our failure to properly remove the content when it is notified of the illegal nature of the content arising out of or on the grounds of, or originating from the content that you have communicated to us.

User-generated content is not approved by us

Our App or site may include information and materials uploaded by other users of the App or site, including to MaiWai shop, ride share, nearby offers, building news, and other push notifications. This information and these materials have not been verified or approved by us. The views expressed by other users on our App or site do not represent our views or values.

How to complain about content uploaded by other users

If you wish to complain about content uploaded by other users (including copyright infringement), please contact us on info@maiwai.app.

We have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.

You are solely responsible for securing and backing up your content. We do not store terrorist content.

Do not rely on information on the App or site

The content on our App and site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our App or site.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our App or site is accurate, complete or up to date.

We are not responsible for websites we link to

Where our App or site contains links to other sites and resources (including those for weather or commuter options) provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.

Our liability

Whether you are an individual or a business user:

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

If you are a business user:

We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

use of, or inability to use, our App or site; or

use of or reliance on any content displayed on our App or site.

In particular, we will not be liable for:

loss of profits, sales, business, or revenue;

business interruption;

loss of anticipated savings;

loss of business opportunity, goodwill or reputation; or

any indirect or consequential loss or damage.

If you are a consumer user:

Please note that we only provide our App or site for private use by individuals employed in certain businesses. We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.

How we may use your personal information

We will only use your personal information as set out in our privacy policy.

We are not responsible for viruses and you must not introduce them

We do not guarantee that our App or site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our App or site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Rules about linking to our App or site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our site in any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

We reserve the right to withdraw linking permission without notice.

The website in which you are linking must comply in all respects with the content standards set out in our Acceptable Use Policy.

Which country’s laws apply to any disputes?

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
